1. Introduction

These Terms and Conditions ("Terms") govern your use of the Opera Peinture mobile application ("App"), available on Android and iOS. Opera Peinture is a platform that connects users with verified professional painters and painting shops in Algeria.

By creating an account or using the App, you agree to these Terms in full. If you do not agree, please do not use the App.

2. About the App

Opera Peinture is a marketplace platform. We do not perform painting services ourselves. We act as an intermediary that:

• Allows users to discover and contact professional painters and shops
• Allows verified painters and shops to list their services and receive requests
• Mediates in the event of a dispute between both parties

3. Eligibility

To use Opera Peinture you must:

• Be at least 18 years old
• Be located in Algeria
• Provide accurate and complete registration information
• Agree to these Terms and our Privacy Policy

4. User Accounts

4.1 Registration You must create an account using a valid email address and a secure password. You are responsible for keeping your credentials confidential and for all activity that occurs under your account.

4.2 Accuracy You agree to provide truthful, accurate, and up-to-date information at all times. Opera Peinture reserves the right to suspend or delete accounts containing false or misleading information.

4.3 Account Security If you suspect unauthorized access to your account, notify us immediately at allo@operapeinture.com.

5. Painter & Shop Accounts

5.1 Verification Painters and shops wishing to list their services on the App must register and submit to a verification process conducted by Opera Peinture. Listing is only permitted upon our approval.

5.2 Accuracy of Listings Painters and shops are solely responsible for the accuracy, quality, and completeness of the information they publish, including service descriptions, pricing indications, photos, and availability.

5.3 Professional Conduct Verified service providers agree to treat users with respect, honor confirmed service requests, and maintain professional standards at all times. Failure to do so may result in removal from the platform.

5.4 Removal Opera Peinture reserves the right to suspend or permanently remove any painter or shop from the platform at its sole discretion, including for poor user feedback, misconduct, or inaccurate listings.

6. Booking & Services

6.1 Requesting a Service Users can browse available painters and shops, view their profiles, and send a service request through the App. A booking is confirmed only when the painter or shop accepts the request.

6.2 No Employment Relationship Painters and shops listed on Opera Peinture are independent professionals. They are not employees, agents, or representatives of Opera Peinture. Opera Peinture is not a party to any service agreement between a user and a painter or shop.

6.3 Service Execution The actual painting service takes place outside the App, at the location agreed upon between the user and the service provider.

7. Payment

All payments for painting services are made directly between the user and the painter or shop, outside of the App (e.g., cash on site). Opera Peinture does not process, hold, or guarantee any payments. Any pricing displayed on the App is indicative and subject to final agreement between the user and the service provider.

8. Cancellations

8.1 By Users Users may cancel a service request through the App before the service begins. We encourage cancellations to be made as early as possible out of respect for the service provider's time.

8.2 By Painters / Shops Service providers may cancel an accepted request only for legitimate reasons. Repeated unjustified cancellations may result in suspension from the platform.

9. Dispute Resolution

9.1 Mediation by Opera Peinture If a dispute arises between a user and a painter or shop (e.g., service not performed as described, unprofessional behavior, disagreement over scope of work), either party may contact us at allo@operapeinture.com to request mediation.

9.2 Our Role Opera Peinture will review the situation impartially, communicate with both parties, and propose a fair resolution. While we will make every effort to mediate effectively, we do not guarantee specific outcomes and our mediation is not legally binding.

9.3 Escalation If mediation does not resolve the dispute, either party may pursue the matter through the competent Algerian courts.

10. Photos & User Content

By uploading photos or any content to the App, you grant Opera Peinture a non-exclusive, royalty-free license to use, display, and store that content solely for the purpose of operating and improving the App. You confirm that you own or have the right to share any content you upload.

Opera Peinture reserves the right to remove any content that is inappropriate, offensive, or in violation of these Terms.

11. Prohibited Conduct

When using Opera Peinture, you must not:

• Provide false information or impersonate another person
• Use the App for any unlawful purpose
• Post offensive, defamatory, or misleading reviews or content
• Attempt to contact or transact with service providers outside the App in order to bypass our platform
• Interfere with or disrupt the App's infrastructure or security
• Scrape, copy, or reproduce any part of the App without our written consent

12. Reviews & Ratings

Users may leave reviews and ratings for painters and shops after a completed service. Reviews must be honest, fair, and based on genuine experience. Opera Peinture reserves the right to remove reviews that are abusive, fabricated, or in violation of these Terms.

Painters and shops may not solicit, incentivize, or manipulate reviews in any way.

13. Intellectual Property

All content within the App, including the name "Opera Peinture," the logo, design, and code, is the exclusive property of Opera Peinture and is protected under applicable Algerian intellectual property law. You may not reproduce, distribute, or create derivative works from any part of the App without our prior written permission.

14. Limitation of Liability

To the fullest extent permitted by Algerian law, Opera Peinture shall not be liable for:

• The quality, safety, or outcome of any painting service performed by a listed provider
• Any direct or indirect damages arising from interactions between users and service providers
• Any loss resulting from unauthorized access to your account due to your failure to secure your credentials
• Temporary unavailability of the App due to maintenance or technical issues

15. Termination

By You: You may delete your account at any time from the App's settings or by contacting us at allo@operapeinture.com.

By Us: We reserve the right to suspend or terminate any account that violates these Terms, without prior notice in cases of serious breach.

Upon termination, your right to use the App ceases immediately. Sections 10, 13, 14, and 16 survive termination.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of Algeria. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the competent Algerian courts.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will notify you via push notification or email before the changes take effect. Continued use of the App after that date means you accept the updated Terms.
